Glad to know that I'm keeping ya'll amused. I'll take that as a roar of applause from the onlookers! Tongue

At what point do you believe that the person in charge (whether it is a bartender, wait staff, manager, or owner) of an establishment (which provides liquid alcohol) should allow a paying patron (or friend, or ex) to exit the premises and enter a motorized vehicle, turn the key and stammer off into the world of innocence?

You should have contacted the legal team of Michael's (in Knoxville) when they were taken to court for all of the drunk drivers leaving their establishment...

You have failed to answer the question.

Thank you (nicely stated), for playing.

Unfortunately, judges are the final word ...

Huh? And just what unAmerican process do you propose to keep Judge's from having the final say in a legal proceding where they are to assigned to be the judge?

Wow! This is stupidy on stilts, as doc would say.

askwhy Wrote:
And doc would be just as mistaken. I have no problem with the American process and simply stated that in this jurisdiction, the judges are the final authority.

Uh, AW, you are the one mistaken. You simply discount the checks and balances of the District Attorney's office, the power of the Criminal/Circuit Court judges, and the appellant process in general. "The judges in this jurisdiction are not the final say" for those reasons. If the DA doesn't take action for an illegal act, or if it is not appealed up by the DA, then the final say is with the last judge by default only.

If one of them decides to exceed their authority or make inappropriate decisions based on politics or personal interests, they have the power to do so. This is not the first "connected" person to be stopped or arrested. I don't personally know whether she got one of your sweet deals or not. Is she working? Did she finish school? Does she have a drug problem? Aren't these the questions you should be asking?

If a judge exceeds their authority an appeal is likely. And yes you have many problems with the American Judicial system.

Take a fair look at the last few "connected" people with DUIs and tell me you agree with the outcomes and think that they got exactly the same treatment as Joe Six-Pack gets.

Tell you what, instead of doing that, why don't you watch for it to happen again, or hell, take this particular case and report it to the AOC, Court of the Judiciary, and The Board of Professional Responsibility. That is the proper forum. For every problem in the system there is a remedy in place. You have to be willing to use it though.

Have at it Dick Tracy. Might even want to call them on the neat wrist watch radio you carry.

So fess up - did you copy answers off of the other students when you were in grade school too?

Goodness - http://www.state.tn.us/abc/January%20Min...202007.pdf

You might want to note the areas which contain statements such as "in 2004 Michael's led the list of thirty-five (35) individuals who admitted to the police officers that they had purchased alcoholic beverages at Michael's." In 2005 there were 39, 2006 a mere 43.

They were ALSO being charged with serving minors, patrons who entered the establishment intoxicated, etc.

Never mind with you - I need an aspirin. You are a headache.

Hmmmm, I was just told that Champ and his wife are divorced. Didn't know that.
Looks like she's still good enough friends with Layton to get preferential treatment however!

Imagine a wife divorcing a prize like Champ!
Thought everyone knew that. He was represented by the Hunt ( I guess to pay off campaign debts). Do they still go in public register in the paper?

Not only a prize as a husband he is also such a role model as a father too, especially if the kids are young girls.

What I want to know is has anyone verified the reported DUI suspect's social history (let's say health, education, work history, or financial status)?...

No, it hasn't nimrod. Firstly there is no conviction, it is a bailable offense. Secondly, it is a misdemeanor and this is not generally done on midemeanants. You do understand the difference between a felony and misdemeanor, right?
